Terms & Conditions

By accessing or using the TRAS Auction platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms apply to all visitors, registered users, bidders, and any other persons who access or use the Platform in any capacity.

TRAS Auction reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Platform following any changes constitutes acceptance of the revised Terms. The date of the most recent revision will be indicated at the top of this page.

To register as a bidder on the Platform, you must be at least 18 years of age and legally capable of entering into binding contracts under Malaysian law.

You must provide accurate, complete, and current information during registration. TRAS Auction reserves the right to suspend or terminate accounts found to contain false or misleading information.

Employees, agents, and immediate family members of MechaTRAS Sdn Bhd and Mechanikos Sdn Bhd are not permitted to participate in auctions listed on the Platform.

All bids placed on the Platform are legally binding offers. Once a bid is submitted, it cannot be withdrawn or amended under any circumstances.

The highest bid at the close of an auction constitutes an offer to purchase. The sale is only concluded upon confirmation by the auctioneer and receipt of the full deposit or purchase consideration as required.

TRAS Auction employs server-side timestamping to resolve simultaneous bids. The bid received first at the server level will take precedence. All bidding activity is recorded in an immutable audit log.

TRAS Auction reserves the right to reject, cancel, or void any bid at its absolute discretion, including but not limited to bids made in bad faith, bids from suspended accounts, or bids that violate these Terms.

A refundable deposit is required prior to participation in any auction. The deposit amount is specified on the individual auction listing page and is typically between 5% and 10% of the reserve price.

Deposits must be received and confirmed before a bidder is granted access to the live bidding room. Payment must be made via the methods specified by TRAS Auction and must include the unique reference number provided.

Unsuccessful bidders will receive a full refund of their deposit within 5–7 working days after the auction closes. Winning bidders' deposits will be applied toward the purchase price.

Failure to complete payment of the balance purchase price within the stipulated timeframe will result in forfeiture of the deposit and may result in legal action.

All assets listed on the Platform are sold on an "as-is, where-is" basis. TRAS Auction makes no representations or warranties, express or implied, regarding the condition, quality, fitness for purpose, or title of any asset.

Asset descriptions, images, and supporting documents are provided for general reference only. Prospective bidders are strongly encouraged to conduct their own due diligence, including physical inspections where permitted, prior to placing a bid.

TRAS Auction shall not be liable for any loss or damage arising from reliance on information provided in asset listings, including but not limited to errors, omissions, or inaccuracies.

TRAS Auction is committed to protecting your personal data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia. By using the Platform, you consent to the collection, processing, and use of your personal data as described in our Privacy Policy.

Your personal data will only be used for purposes directly related to your use of the Platform, including account management, auction participation, payment processing, and regulatory compliance.

We do not sell, rent, or share your personal data with third parties except as required by law or with your explicit consent.

To the maximum extent permitted by applicable law, TRAS Auction, MechaTRAS Sdn Bhd, and Mechanikos Sdn Bhd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

TRAS Auction does not guarantee uninterrupted or error-free operation of the Platform. We shall not be responsible for any losses resulting from technical failures, connectivity issues, or system downtime during live auctions.

Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the total deposit amount paid by you in relation to the specific auction to which the claim relates.

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

TRAS Auction encourages users to contact our support team in the first instance to resolve any disputes informally before initiating formal legal proceedings.

Nothing in these Terms shall be construed as limiting the rights of either party to seek injunctive or other equitable relief in any court of competent jurisdiction.
